Website Terms And Conditions Of Use

These terms cover your use of the www.webup.co.uk website. They are not the terms of any work we do for you — those are in our Project Terms & Conditions, which take precedence over this page for anything to do with a project.

1Who runs this website

This website is operated by WebUp® Media, which is the trading name of Gareth Williams, a sole trader. Where these terms say ‘WebUp’, ‘WebUp Media’, ‘we’, ‘us’ or ‘our’, that is who they mean. ‘You’ means anyone using or viewing the site.

  • Business address: 8 Ffordd Pendyffryn, Prestatyn, LL19 9RY. We are a sole trader, so this is our business address rather than a registered office, and we have no company registration number.
  • Email: hello@webup.co.uk
  • Phone: 0800 246 1142

WebUp® and WebUp Media® are our registered trade marks.

2Accepting these terms

By using this website you accept these terms. If you do not accept them, please stop using the site.

We may update these terms from time to time, for example if the law changes or we add something new to the site. The version on this page is the one that applies, and the date it last changed is shown at the bottom. Please check back occasionally.

3Cookies and your privacy

We set only the cookies we need to run the site unless you tell us we may set more. You are asked when you first visit, and you can change your answer at any time using the Cookie Settings link at the bottom of every page.

Every cookie the site uses, who sets it and how long it lasts is listed in our Cookie Policy. What we do with personal information more generally, and the rights you have over it, is set out in our Privacy Policy.

4The content on this site

The pages here are for general information. We keep them up to date as best we can, but content can change without notice and we do not promise that everything is complete, accurate or current at the moment you read it. Prices, packages and examples of our work are illustrations, not offers.

Nothing on this site is professional advice for your particular situation. Please talk to us before acting on it, so we can look at what you actually need.

5Using the site properly

You may look at our pages, and print or download extracts for your own use or to show to someone else in your organisation. Please do not:

  • use the site for anything unlawful, or in a way that breaks the Computer Misuse Act 1990;
  • try to gain unauthorised access to the site, its server or any connected system;
  • knowingly introduce viruses or other harmful material;
  • scrape, harvest or systematically copy content, or use our contact form to send unsolicited marketing;
  • attack the site so as to make it unavailable to others.

Doing any of these may be a criminal offence, and we would report it. We may withdraw your access to the site if you breach this section.

6Who owns what is on the site

We own or are licensed to use everything on this website — the design, layout, look, wording, graphics and code. Copying or reusing it, other than as allowed in section 5, needs our written permission.

Trade marks shown here that belong to other people are acknowledged as theirs.

7Links to other websites

Where we link to another website it is because we think it will be useful. It does not mean we endorse it, and we have no control over and take no responsibility for what is on it or what it does with your information.

You are welcome to link to our home page, as long as you do it fairly and do not suggest any association or approval we have not given.

8What we are and are not responsible for

Nothing in these terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot lawfully be limited or excluded. If you are a consumer, nothing here affects your statutory rights.

Subject to that, and to the extent the law allows:

  • we do not give any warranty that the site will be uninterrupted, error free or free of viruses;
  • we are not liable for loss of profit, loss of business, business interruption or loss of anticipated savings arising from your use of, or inability to use, this site;
  • we are not liable for any loss caused by a virus or other harmful material you pick up through this site, or through any site we link to;
  • we are not liable for the content of any linked website.

Different terms apply to work we carry out for clients — see our Project Terms & Conditions.

9Which law applies

These terms, and any dispute arising from your use of this website, are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction. If you are a consumer living elsewhere in the United Kingdom, you keep the benefit of any mandatory protections of the law where you live, and you may bring proceedings in your own courts.

10Getting in touch

If you have a question about these terms, or a concern about anything on this site, email hello@webup.co.uk, call 0800 246 1142, or write to us at 8 Ffordd Pendyffryn, Prestatyn, LL19 9RY.
